Flinders University completed its Independent Statutory Review of the Fair Work Amendment (Paid Family and Domestic Violence Leave) Act 2022 (Cth), which amended the National Employment Standards to provide 10 days of paid family and domestic violence leave to all employees, including casual workers.
The Independent Review’s final report made 12 findings and five recommendations and was delivered to the Australian Government on 30 August 2024, and subsequently tabled in both Houses of Parliament on 9 October 2024. The Australian Government published a response to the review, agreeing to all five of the final report's recommendations on 25 February 2025.
The Review considered the operation and impact of the paid family and domestic violence leave entitlement, including on small businesses, sole traders and people experiencing family and domestic violence, since its commencement in February 2023 for employees of non-small business employers, and 1 August 2023 for small businesses. The Review was also informed by qualitative and quantitative research by the Behavioural Economics Team of the Australian Government (BETA).
Flinders University was engaged by the Australian Government Department of Employment and Workplace Relations to conduct an Independent Statutory Review of the Fair Work Amendment (Paid Family and Domestic Violence Leave) Act 2022 (Cth).
Recommendations of the Independent Review
1. Ongoing evaluation and stakeholder consultation is needed to develop the evidence base on paid FDV leave. As familiarity with the entitlement increases, continued opportunities for stakeholder engagement are important to inform proposals for further reform.
